Statement on EPA report on monitoring controls of the renewable fuel standard program

American Fuel & Petrochemical Manufacturers (AFPM) President Charles T. Drevna issued the following statement on a report by the Environmental Protection Agency’s Office of the Inspector General, “The EPA Should Improve Monitoring of Controls in the RFS Program”: 

“We are pleased that the Environmental Protection Agency’s (EPA) Office of Air and Radiation has agreed to implement the recommendations of EPA’s Inspector General, however, AFPM remains skeptical about a final outcome given the Agency’s noted lack of urgency and transparency in the promulgation process. EPA has proposed regulations for a Quality Assurance Plan to address fraud in the Renewable Fuel Standard (RFS), yet obligated parties still face uncertainty because the Agency has failed to act in a manner that provides market stability. While we support the Agency’s initiative to provide an affirmative defense for liability stemming from invalid RFS credits, as proposed, it is an overly expensive, complex, and burdensome due diligence program that fails to restore liquidity to RFS credits called Renewable Identification Numbers (RINs).”
